Welcome to Kit Supply! These Terms and Conditions govern the sale of used equipment through our website. By purchasing from Kit Supply, you agree to comply with these terms.
1. Definitions

"Kit Supply" refers to JASPER & JONES LIMITED trading as Kit Supply, the provider of the website and seller of equipment.

"Buyer" refers to any individual or business purchasing equipment from Kit Supply.

"Equipment" refers to the used tools and equipment sold by Kit Supply on this website.

"Website" refers to the online platform operated by Kit Supply for the sale of used equipment.
2. Condition of Equipment

All equipment sold on the Kit Supply website is used and sold “as-is.”

Kit Supply makes reasonable efforts to provide accurate descriptions, images, and information about the equipment’s condition.

While we aim to ensure the functionality of equipment, Kit Supply provides no warranty, express or implied, on used equipment unless otherwise stated in writing.
3. Purchase Agreement

By completing a purchase through the Kit Supply website, the Buyer agrees to these Terms and Conditions.

The Buyer acknowledges that the equipment is used and understands the nature of the purchase, including any potential wear and defects.

All sales are final once payment is completed, and ownership transfers to the Buyer upon full payment.
4. Pricing and Payment

Prices listed on the Kit Supply website are in GBP (£) and may be subject to change without notice.

Payments must be made in full via the accepted payment methods provided on the website at the time of purchase.

Kit Supply reserves the right to refuse or cancel an order if payment cannot be processed.
5. Delivery and Collection

Delivery: Kit Supply will arrange delivery of the equipment to the Buyer’s specified address for an additional fee. Estimated delivery times will be provided, but delivery times are subject to change.

Collection: Buyers may arrange to collect their equipment in person from Kit Supply’s premises, by appointment only, if collection is an available option.

Kit Supply is not liable for delays or damages incurred during transport once the equipment has left Kit Supply’s premises.
6. Inspection and Acceptance

The Buyer is responsible for inspecting the equipment upon receipt and must report any issues to Kit Supply within 48 hours of delivery.

Failure to report issues within this timeframe indicates acceptance of the equipment as-is and waives any claims related to its condition upon arrival.
7. Returns and Refunds

As-Is Policy: All equipment is sold as-is, with no right to return for a refund unless Kit Supply has misrepresented the equipment in the product description.

If a return is accepted, the Buyer will be responsible for return shipping costs, and a restocking fee may apply.

Kit Supply reserves the right to inspect returned items to verify claims before processing any refunds.
8. Limitation of Liability

Kit Supply’s total liability for any claim related to the sale of equipment is limited to the amount paid by the Buyer for the equipment.

Kit Supply will not be liable for indirect, incidental, or consequential damages, including loss of profits, loss of business, or third-party claims.

The Buyer agrees that Kit Supply is not responsible for any injuries, damages, or losses caused by the equipment’s use after purchase.
9. Warranty Disclaimer

All used equipment sold on the Kit Supply website is sold without any warranty unless explicitly stated otherwise.

Kit Supply disclaims any implied warranties of merchantability or fitness for a particular purpose to the fullest extent permitted by law.
10. Indemnity

The Buyer agrees to indemnify, defend, and hold harmless Kit Supply from any claims, damages, or expenses arising out of the Buyer’s use or resale of the equipment.
11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom.

Any disputes arising from these Terms and Conditions or from the purchase of equipment from Kit Supply shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Terms and Conditions for Tool and Equipment Hire
1. Definitions

"Company" refers to Jasper & Jones Limited trading as Kit Supply (the provider of the equipment).

"Hirer" refers to the individual or business hiring the equipment.

"Equipment" refers to any tools or equipment hired from the Company by the Hirer.
-
"Hire Period" refers to the time period during which the Hirer has possession of the equipment.
2. Hire Agreement

By signing or agreeing to this Hire Agreement, the Hirer confirms acceptance of these Terms and Conditions and agrees to pay all hire charges, including any additional fees for loss or damage to equipment.

The Hire Period will commence on the day the Hirer takes possession of the equipment and will end when the equipment is returned to the Company in the same condition it was hired, subject to normal wear and tear.
3. Payment Terms

All hire charges are payable in full, in advance, unless otherwise agreed in writing.

Late payment may result in additional charges, including interest on overdue amounts, charged at 1.5% per month.

Any deposit requested must be paid before the commencement of the hire. The deposit will be refunded upon safe return of the equipment, subject to the terms of this agreement.
4. Use of Equipment

The Hirer is responsible for ensuring that the equipment is used in a safe, lawful, and appropriate manner. The Hirer agrees to comply with all relevant health and safety regulations.

The Hirer must ensure that the equipment is used only by trained and competent persons and for its intended purpose.

The Hirer must not make any alterations or repairs to the equipment without the Company’s prior written consent.
5. Damage, Loss, and Theft

The Hirer accepts full responsibility for the equipment from the time of collection or delivery until it is returned to the Company. Any loss, theft, or damage to the equipment, regardless of cause, will be the responsibility of the Hirer.

In the event of theft, the Hirer must report the incident to the police immediately and provide the Company with a crime reference number.

The Hirer will be charged for the repair or replacement of any lost or damaged equipment. The Company reserves the right to determine whether damaged equipment should be repaired or replaced.
6. Liability and Insurance

The Hirer is responsible for obtaining adequate insurance for the equipment during the Hire Period, including cover for theft, loss, or damage to third parties (public liability insurance).

The Company is not liable for any loss, damage, or injury caused to the Hirer, their employees, or third parties arising from the use or possession of the equipment during the Hire Period.

The Hirer agrees to indemnify the Company against all claims, liabilities, losses, or damages arising directly or indirectly out of the use of the equipment, including any third-party claims for damage or injury.
7. Third-Party Damage

The Hirer acknowledges full responsibility for any damage caused to third-party property or individuals resulting from the use of the hired equipment. This includes, but is not limited to, damage caused during transport, operation, or storage of the equipment.

The Company will not be held liable for any damage or injury caused to third parties as a result of improper or unsafe use of the equipment.

The Hirer is required to have and maintain a hire-in insurance policy that covers damage to third parties caused by the use of the hired equipment. Proof of insurance may be requested by the Company at any time.
8. Collection, Delivery, and Return of Equipment

Delivery and collection of equipment can be arranged by the Company, but charges may apply. The Hirer must ensure that someone is present to accept delivery or collection during the agreed times.

The Hirer must return the equipment to the Company by the agreed date and time. Late returns may incur additional hire charges.

The equipment must be returned in the same condition as it was provided, subject to normal wear and tear. Any cleaning or maintenance required upon return, beyond normal use, may incur additional charges.
9. Termination

The Company reserves the right to terminate the hire agreement and recover the equipment at any time if the Hirer is in breach of these Terms and Conditions.

The Hirer agrees to make the equipment available for collection immediately upon termination of the agreement.
10. Indemnity

The Hirer agrees to fully indemnify the Company against any loss, damage, or legal expenses incurred as a result of the Hirer’s breach of these Terms and Conditions, negligence, or unlawful use of the equipment.

This indemnity includes any claims made by third parties arising from the Hirer’s use of the equipment.
11. Limitation of Liability

The Company’s total liability for any claim under this agreement will be limited to the total hire charges paid by the Hirer.

The Company will not be liable for any indirect or consequential losses, including but not limited to loss of profits, business, or opportunity.
12. Force Majeure

The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, fire, flood, pandemic, strikes, or government restrictions.
13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom, and any disputes arising shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
14. Agreement

By signing this agreement or proceeding with the hire, the Hirer agrees to these Terms and Conditions and acknowledges that they have read and understood them fully.
